Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of the Varatron Health website and services ("Service"). By creating an account, completing a visit, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and a resident of a U.S. state where our affiliated clinicians are licensed. You agree to provide accurate, current, and complete information during a visit and to keep your account information up to date.

3. Nature of the service

Varatron operates a technology platform that connects patients with independently licensed clinicians and licensed pharmacies. Varatron itself does not practice medicine. The clinical decisions made during your visit are the responsibility of the licensed clinician who reviews your case. Prescriptions are issued only after a clinical evaluation, and the clinician may decline to prescribe based on professional judgment.

4. Not for emergencies

The Service is not intended for emergencies or urgent care. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.

5. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at support@varatron.com if you suspect unauthorized access.

6. Payment, refunds, and subscriptions

You agree to pay all fees disclosed at the time of purchase. Visit fees are generally non-refundable once a clinician has reviewed your case. Subscription plans renew automatically until canceled. Cancel any time from your account or by emailing support@varatron.com; cancellation stops future charges and does not refund prior charges except as required by law.

7. Privacy and data use

Your use of the Service is also governed by our Privacy Policy. As stated there, we do not sell your personal or health information, and we do not use your data to train artificial intelligence or machine-learning models.

8. Acceptable use

You agree not to: misrepresent your identity or health information; use the Service to obtain medications for resale, diversion, or anyone other than yourself; attempt to access another user's account; or interfere with the security or operation of the Service.

9. Intellectual property

The Service, including its design, code, and content, is owned by Varatron Health or its licensors and is protected by intellectual property laws. You may use the Service for its intended purpose only.

10. Disclaimers

The Service is provided "as is" without warranties of any kind beyond those required by law. Varatron does not guarantee specific health outcomes. Information available through the Service is not a substitute for professional medical advice from your in-person primary care provider.

11. Limitation of liability

To the fullest extent permitted by law, Varatron's aggregate liability arising out of or relating to the Service will not exceed the amount you paid us in the 12 months preceding the claim. This limitation does not apply to liability for the professional services of licensed clinicians, which are the responsibility of the treating clinician and their professional liability insurance.

12. Governing law

These Terms are governed by the laws of the state in which Varatron Health is incorporated, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts of that state, except where applicable law provides otherwise.

13. Changes

We may update these Terms from time to time. We will post the updated Terms here and update the "Last updated" date. Material changes will be communicated to active patients by email. Continued use of the Service after a change constitutes acceptance.
